I mean Red Hood, one would think, is a master escape artist and would prove a useful operative to high ranking government officials. Those type of people don't go to jail.
I am thinking of David Cain and Deathstroke right now. Seems that whenever they fight Batman doesn't even consider turing them over to the cops because it would be a waste of time. So what is he gonna do with Red Hood.
Also has anyone asked Jason why he is using Joker's old ID or why he didn't kill Joker when he first encountered him?

Pretty much, in Alan Moore's Killing Joke flashbacks suggested that Joker was the Red Hood, but we can't be sure since the flashbacks were the Joker's, and he said he preferred to remember his past in "multiple choice." Although while it may be just speculation for us, it is also speculation in the DCU, and Jason probably thought "Joker was probably the Red Hood, I'll just go with that ID".

I don't think it'll ever come to this point. My friend gave an interesting theory that I think might hold up. I'm not sure if he came up with it, or if other people have talked about it. But here it is.

The theory my friend was talking about is that time is warping through the Crisis. It's why the golden age characters were able to bust through the dimensional divide. It's why Donna Troy came back, inexplicably...I know they gave an explanation, but it was more complex than time warping. It's also the reason that Jason Todd is still alive. In this version of the time stream, the call voting went the other way. Jason Todd was saved by 100 calls :D His idea is that when the Crisis is finished, some of this stuff will be returned to normal. Other things, will stay the same and severely impact the DCU.
I don't know if he's right, or not, but it's an interesting theory.

And a sales dropper. If you remember, the FANS wanted Jason gone, so he went. I dont think many would like him to come back as Batman.

I like seeing him back. But as Batman? Nah. Nightwing would make a better stand-in, he's done it before.

The fans wanted him gone...barely. It was about 50/50, similar to the Hal/Kyle split. And this Jason Todd obviously isn't the Jason Todd of the '80s

Yeah, he's not good. So some are actually thinking we're gonna have an evil Batman? Thats hardcore.

It would be awesome if Jason killed Bruce, took over the mantle and was an evil version of Batman for a year or two until the others in the family take him down

Jason's not "evil", he's just more determined in his zeal against crime. He's willing to kill criminals, which Batman is not. He violates Batman's ethics, but he isn't necessarily "evil."

He is also willing to kill innocent bystanders and other heroes. Basically anyone who doesn't see things his way.

The only hero he's tried to kill is Onyx... and I don't think he was trying to kill Tim, just beat the crap out of him. And he's made a point that drug dealers should leave children alone.
